These materials are protected under Australian copyright and intellectual property law.
Students are granted a limited, non-exclusive, non-transferable licence to use these materials solely for their personal exam preparation for the:
Victorian Bar Entrance Examination, and
New South Wales Bar Examination.
Students must not:
reproduce or distribute materials
upload materials online
share materials with other candidates
publish materials on forums, social media, or tutoring platforms
sell or commercially exploit any materials.
Any unauthorised reproduction, sharing, or distribution of Bar Exam Prep materials constitutes a breach of these Terms and may result in termination of access and legal action.
2. Acceptable Use and User Conduct
Users agree to use Bar Exam Prep services and materials solely for lawful personal study purposes.
Users must not:
share login details with other individuals
screen-record tutoring sessions without permission
distribute materials to third parties
misrepresent themselves as affiliated with Bar Exam Prep.
Users must conduct themselves respectfully during tutoring sessions.
Bar Exam Prep reserves the right to suspend or terminate services where users engage in:
abusive conduct
academic misconduct
unauthorised sharing of materials
any activity that harms the integrity of the tutoring service.
3. Protection of Educational Materials
Bar Exam Prep takes reasonable steps to protect the integrity of its educational materials.
Where unauthorised distribution, reproduction, or misuse of materials occurs, Bar Exam Prep may take appropriate action including:
suspension or termination of access to tutoring services
removal of access to educational resources
seeking legal remedies available under Australian law.
4. Suspension or Termination of Access
Bar Exam Prep reserves the right to suspend or terminate a user's access to tutoring services or educational materials if the user:
breaches these Terms and Conditions
engages in unauthorised sharing or distribution of materials
uses the service in a manner inconsistent with its intended educational purpose.
Where access is terminated due to a breach of these Terms, refunds may not be provided.
5. Booking, Cancellation and Refund Policy
All tutoring sessions are subject to the Bar Exam Prep Booking, Cancellation and Refund Policy, which forms part of these Terms and Conditions.
That policy governs:
cancellation of sessions
rescheduling of sessions
refunds for pre-purchased session packs.
6. Educational Purpose and No Legal Advice
All tutoring sessions, feedback, and materials provided by Bar Exam Prep are supplied for educational and exam preparation purposes only.
Nothing provided through Bar Exam Prep constitutes:
legal advice
professional legal services
advice regarding eligibility for admission to practice
advice regarding bar admission requirements.
Students should consult the relevant authorities for official guidance, including:
the Victorian Bar, and
the New South Wales Bar Association.
7. No Guarantee of Examination Results
Bar Exam Prep provides tutoring designed to assist candidates in preparing for the Victorian Bar Entrance Examination and the New South Wales Bar Examination.
However:
passing the examination is not guaranteed, and
use of Bar Exam Prep services does not ensure admission to the bar.
Examination results depend on numerous factors beyond the control of Bar Exam Prep, including individual preparation, examination conditions, and decisions of the relevant examining authorities.
8. Disclaimer of Liability
To the maximum extent permitted by law, Bar Exam Prep is not liable for any loss, damage, or expense arising from:
reliance on tutoring sessions or materials
examination outcomes
admission decisions made by bar authorities
interruptions or technical issues affecting tutoring sessions or the website
delays or changes in session scheduling.
Where liability cannot be excluded under the Australian Consumer Law, Bar Exam Prep's liability is limited, at its option, to:
re-supplying the tutoring services, or
refunding the fees paid for the relevant services.
Bar Exam Prep is not liable for indirect, incidental, or consequential damages, including loss of opportunity or examination outcomes.
9. Website and Platform Availability
Bar Exam Prep does not guarantee that the website, booking platform, or online tutoring tools will always be available or free from technical errors.
While reasonable efforts will be made to maintain reliable services, Bar Exam Prep is not responsible for interruptions caused by:
third-party platforms
internet connectivity issues
system maintenance or technical faults.
10. Changes to Terms
Bar Exam Prep may update these Terms and Conditions from time to time.
Updated terms will be published on the website and take effect from the date of publication.
Continued use of Bar Exam Prep services constitutes acceptance of the updated Terms.
11. Governing Law
These Terms and Conditions are governed by the laws of Australia.
